The Ministry says “for the avoidance of doubt, no person or entity is to carry out any development on the said land […]</p> <p>The post <a href="https://www.sweetmelodiesfm.com/76936-2/">‘No further development at Bulgarian Embassy pending court cases’ – Lands Ministry orders</a> appeared first on <a href="https://www.sweetmelodiesfm.com">Sweet Melodies FM</a>.</p> ]]></description> <content:encoded><![CDATA[<p><strong>The Ministry of Lands and Natural Resources has directed that there should be ‘no further developments” on the land housing the demolished Bulgarian Embassy in Accra pending the final determination of legal matters.</strong></p> <p>The Ministry says “for the avoidance of doubt, no person or entity is to carry out any development on the said land until the conclusion of the said court cases.”</p> <p>It said there are pending court cases and that the Lands Commission should ensure that there is no further development of the land pending the outcome of the cases.</p> <p>The Ministry is giving the orders on the back of its release of portions of the Sole Inquirer’s Report into the matter.</p> <p>The Bulgarian Embassy, located at Kakramadu Road, Plot No. 10, East Cantonments in Accra, was partly demolished by a so-called private developer in 2017.</p> <p>The Lands Commission ordered the developer to stop work on a redevelopment project on the site, but work has since been progressing.</p> <p>The Bulgarian Ambassador to Ghana and Nigeria, Yanko Yordanov, has accused the Ghanaian government of breaching the Vienna Convention on Diplomatic Relations.</p> <p>He warned of far-reaching implications on diplomatic relationships with Ghana due to the demolition of a facility on the premises of its Embassy in Accra.</p> <p>Yanko Yordanov, who is worried about the turn of events, called on the government of Ghana to as a matter of urgency ensure that the protocols of the Vienna Convention on Diplomatic Relations are respected.</p> <p>Government thus appointed a retired justice of the High Court, Justice Kwasi Anto Ofori-Atta as Sole Inquirer.</p> <p>The Sole Inquirer who looked into the demolition of the structure at the Bulgarian Embassy recommended the sanctioning of the supposed private developer who caused the destruction of the Embassy’s building.</p> <p>The developer is also been directed to pay compensation to affected persons in the destruction.</p> <p>The private developer, Jojo Hagan, is said to have taken over as the Executor of the Will of one Mr. Leighton and vested the property in the named beneficiaries of the Will while pursuing the cases at the Court.</p> <p>He also obtained judgment for the eviction of the occupants whom he described as trespassers and an order to demolish the property which he described as unfit for human habitation, at the Circuit Court, Accra.</p> <ul> <li><a href="https://www.sweetmelodiesfm.com/bulgarian-embassy-structure-was-demolished-without-the-involvement-of-the-government-according-to-the-foreign-affairs-ministry/">Bulgarian Embassy structure was demolished without the involvement of the government, according to the Foreign Affairs Ministry</a></li> <li>‘<a href="https://www.sweetmelodiesfm.com/if-you-have-nothing-to-conceal-publish-the-whole-report-on-the-bulgarian-embassy-demolition-minority/">If you have nothing to conceal, publish the whole report on the Bulgarian Embassy demolition’– Minority</a></li> </ul> <p>His action of evicting the trespassers and also causing the demolition of the property according to the report did not “follow due process”.</p> <p>This, the Sole Inquirer, finds wrong and recommends that Mr. Hagan must be allowed to face the law.</p> <p>“Mr. Jojo Hagan should be sanctioned for not following due process in the eviction of the alleged trespassers and the demolition of the building and should be made to compensate the Bulgarian Embassy”, part of the report read.</p> <p>The Sole Inquirer also recommended that since the title to the land has not been determined by the Courts, it is advised that the government should intervene in finding an amicable solution to this matter.</p> <p>Following the release of his report, the Ministry of Lands and Natural Resources said after studying the 149 page report of the Sole Inquirer, it accepts the findings and recommendations of the Sole Inquirer in full.</p> <p>It added that it has begun taking the necessary steps to implement the recommendations of the Sole Inquirer.</p> <p>The Ministry also says, it has decided to do the following in addition:</p> <p>1. the Sole Inquirer established as a matter of fact that the cancellation of the Bulgarian Embassy’s interest did not follow due process. Since the registration of the assignment of Dr. Yaw Adu-Ampomah is found, as indicated in the Sole Inquirer’s report to have been improperly obtained, the Ministry has further directed the Lands Commission to take the necessary steps to withdraw consent granted to the said assignment and the registration of the interest of Dr. Yaw Adu- Ampomah, pending the outcome of the court cases;</p> <p>2. the Lands Commission is directed not to recognise and/or register any further transaction in respect of the subject plot of land until the final determination of the pending cases before the court (s) or an amicable resolution of the matters in dispute is reached;</p> <p>3. I have also written to the Honourable Attorney-General and Minister for Justice, to advice the Ministry in respect of recommendation one (1) of the Sole Inquirer which states as follows;</p> <p>“Mr. Jojo Hagan should be sanctioned for not following due process in the eviction of the alleged trespassers and the demolition of the building and should be made to compensate the Bulgarian Embassy”.</p> <p>4. In accordance with the recommendations of the Sole Inquirer, I will use my good offices to attempt a mediation between the parties with the hope of reaching an amicable settlement of the matters in dispute. Ministry of Lands and Natural Resources, says government will soon roll out a loan scheme to encourage private tree growers.</strong> </p> <p>She said the initiative was to sustain the tree planting programme and that 35 people would be given $100,000 each with 10 per cent interest to establish plantations over a period, as pilot. </p> <p>Mr Abu-Juam said though government targeted to plant five million trees, this month, the country planted 6.2 million hoped to increase it next year. </p> <p>Mr Abu-Juam made this known at a Voluntary Partnership Agreement (VPA) impact monitoring validation Impact of VPA Implementation in Ghana”. </p> <p>He said, “Growing trees is a business in its own but it takes a long time to grow and the banks are not ready to give loans and wait for a long time to pay so government must take leadership. </p> <p>We are starting with few people and a 100-year grace period to pay back.” Mr Abu-Juam said government was going to task the banks to take full responsibility of getting back the money. </p> <p>He said once that was successful, government would be encouraged to increase the number of beneficiaries. </p> <p>The Technical Director noted that when done well, tree planting would be recognised as one of the most engaging, environmentally friendly activities that people could take part in to keep the forest reserves intact. </p> <p>He again expressed gratitude to the diplomats, traditional authority, Parliament and the lot of Ghanaians who engaged in tree planting on the day. </p> <p>The Voluntary Partnership Agreement (VPA) is a bilateral timber-trade agreement between the European Union and Ghana a timber-exporting country. </p> <p>Signed in 2009, the VPA enjoins on Ghana to improve forest governance and law enforcement which aims to address illegal logging. </p> <p>Its objective is to collect data on VPA stakeholder deliberative process, livelihood and forest conditions to feed Ghana’s VPA impact monitoring framework. </p> <p>Under the VPA, the partner country agrees to export only legal timber products to the EU.</p> <p>The post <a
